These Terms of Service (“Terms”) govern the use of northglengarryrental.com and rentals or services provided by North Glengarry Equipment Rental, Alexandria, Ontario (“North Glengarry Equipment Rental,” “we,” “us,” or “our”).

By making a reservation, renting equipment, making a payment, or using our services, you agree to these Terms and any rental agreement applicable to your rental.

1. Rental Agreement

Specific rentals may be subject to a separate rental agreement containing additional terms, including the equipment rented, rental period, rental rate, security deposit, delivery charges, operating restrictions, and damage responsibilities.

If there is a conflict between these general Terms and a signed rental agreement, the signed rental agreement will govern to the extent permitted by law.

2. Eligibility to Rent

Renters must be at least 18 years old and legally capable of entering into a binding agreement.

Valid government-issued identification may be required.

We reserve the right to refuse a rental where we reasonably believe the renter or proposed operator cannot safely operate the equipment or where required identification, payment, deposit, insurance, or other requested information has not been provided.

3. Authorized Operators

Equipment may only be operated by the renter or another person authorized under the rental agreement.

The renter is responsible for ensuring that every operator:

  • is legally permitted and physically capable of operating the equipment;
  • has sufficient knowledge and experience to operate it safely;
  • follows all manufacturer instructions and safety requirements;
  • uses appropriate personal protective equipment; and
  • complies with applicable laws and regulations.

The renter remains responsible for the equipment while it is in the renter's possession or control.

4. Rental Period

The rental begins and ends at the times specified in the reservation or rental agreement.

Equipment must be available for return or pickup at the agreed time.

Keeping equipment beyond the agreed rental period without authorization may result in additional daily or other rental charges.

Extensions must be approved by North Glengarry Equipment Rental and are subject to equipment availability.

5. Payment

Unless otherwise agreed in writing, all rental charges, applicable taxes, delivery charges, deposits, and other required amounts must be paid according to the terms stated when the reservation is made.

Additional amounts resulting from extensions, fuel, cleaning, recovery, damage, missing items, or other authorized charges may become payable following the rental.

6. Security Deposits

We may require a refundable security or damage deposit.

The deposit may be held until the equipment has been returned and inspected.

The renter authorizes us, subject to applicable law and the rental agreement, to apply the deposit toward amounts properly owing as a result of the rental.

The renter's financial responsibility is not necessarily limited to the amount of the security deposit.

7. Inspection and Acceptance

The renter should inspect the equipment upon pickup or delivery and immediately report any visible damage, defects, or missing items.

Acceptance of the equipment confirms that, except for conditions documented at the beginning of the rental, the renter received the equipment in reasonably satisfactory condition.

Photos or videos may be taken before and after rentals to document equipment condition.

8. Proper Use of Equipment

Equipment must be used only for its intended purpose and within its rated capacity.

The renter must not misuse, abuse, overload, race, intentionally damage, improperly modify, or use equipment in a reckless or unsafe manner.

Equipment must not be used:

  • while the operator is impaired by alcohol, cannabis, drugs, medication, fatigue, or another condition that makes operation unsafe;
  • for illegal activities;
  • beyond manufacturer-rated capacities;
  • in an unsafe environment;
  • by unauthorized operators; or
  • in a manner contrary to instructions provided by North Glengarry Equipment Rental or the manufacturer.

9. Maintenance During Rental

The renter is responsible for reasonable daily operating checks appropriate to the equipment, which may include checking engine oil, coolant, hydraulic fluid, grease points, tire condition, track condition, and other normal operator-level inspection items.

The renter must immediately stop using the equipment if warning lights, abnormal noises, overheating, significant leaks, mechanical problems, or unsafe operating conditions occur.

Continuing to operate equipment after a significant warning or malfunction may make the renter responsible for resulting damage.

10. Fuel

Unless otherwise stated, equipment should be returned with approximately the same fuel level as when provided.

The renter must use the correct type of clean fuel.

Damage caused by incorrect, contaminated, or unsuitable fuel may be charged to the renter where the renter is responsible for the contamination or incorrect fueling.

11. Damage and Loss

The renter is responsible, to the extent provided by the rental agreement and applicable law, for loss or damage occurring while the equipment is in the renter's possession or control where that loss or damage results from misuse, negligence, unauthorized use, theft attributable to failure to take reasonable security precautions, collision, rollover, improper transportation, vandalism, or violation of the rental agreement.

Ordinary wear and tear resulting from proper use is not considered customer-caused damage.

12. Tires, Tracks and Undercarriage

Cuts, punctures, sidewall damage, track derailment caused by improper operation, damage from operating over unsuitable materials, and similar operator-caused damage may be the renter's responsibility.

Ordinary wear from normal operation is not chargeable as customer damage.

13. Cleaning

Equipment is expected to be returned in reasonably similar cleanliness to when it was rented, allowing for ordinary use.

Additional cleaning charges may apply where equipment is returned with excessive mud, concrete, asphalt, paint, chemicals, garbage, manure, hazardous substances, or other contamination requiring unusual cleaning.

14. Transportation and Delivery

Where North Glengarry Equipment Rental provides delivery or pickup, the customer must provide safe and reasonable access to the delivery location.

The customer is responsible for identifying hazards including soft ground, overhead wires, underground utilities, narrow entrances, septic systems, unstable surfaces, or other conditions that could affect safe delivery.

We may refuse to enter a location we reasonably consider unsafe or likely to damage our truck, trailer, equipment, or property.

Additional charges may apply for unsuccessful delivery or pickup attempts, excessive waiting time, recovery, or additional trips caused by conditions within the customer's control.

15. Customer Transportation

Where customers transport rental equipment themselves, they are responsible for using a suitable vehicle and trailer and complying with all applicable licensing, load securement, weight, towing, and highway requirements.

We may refuse to release equipment if we reasonably believe the proposed transportation method is unsafe or unlawful.

16. Accidents, Theft and Damage

Accidents, theft, vandalism, major damage, or other significant incidents involving rental equipment must be reported to North Glengarry Equipment Rental as soon as reasonably possible.

Where appropriate, the renter must also contact police, emergency services, their insurer, or other authorities.

The renter must reasonably cooperate with any subsequent insurance claim or investigation.

17. Breakdown and Repairs

The renter must contact North Glengarry Equipment Rental before performing or authorizing repairs.

Except in an emergency necessary to prevent injury or further property damage, unauthorized repairs or modifications must not be performed.

Mechanical breakdowns that are not the renter's fault will be handled in accordance with our Refund & Cancellation Policy and rental agreement.

18. Assumption of Risk

Operating construction equipment, excavators, skid steers, loaders, trailers, attachments, compactors, and similar equipment involves inherent risks.

The renter and authorized operators are responsible for operating equipment safely, evaluating job-site conditions, locating underground and overhead hazards, and determining whether the equipment is suitable for the intended work.

Nothing in these Terms excludes liability that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, North Glengarry Equipment Rental will not be responsible for indirect, incidental, special, or consequential losses arising from equipment downtime, project delays, lost profits, missed deadlines, substitute equipment, or similar economic losses.

This limitation does not apply where liability cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by law, the renter agrees to be responsible for claims, losses, damage, or reasonable costs arising from the renter's or an authorized operator's negligent, unlawful, unauthorized, or improper use of the equipment.

Nothing in this provision requires the renter to indemnify North Glengarry Equipment Rental for liability that applicable law does not permit us to transfer to the renter.

21. Underground and Overhead Utilities

The renter is responsible for ensuring that the work area has been appropriately assessed for underground and overhead hazards before operating equipment.

This includes obtaining any required utility locates before digging.

North Glengarry Equipment Rental is not responsible for selecting excavation locations or determining whether a customer may legally or safely excavate at a particular location.

22. Prohibited Transfer or Sub-Rental

Rental equipment may not be sold, pledged, loaned, sub-rented, transferred, or provided to another person or business without our prior written permission.

23. Theft Prevention and Equipment Location

The renter must take reasonable precautions to protect equipment against theft or unauthorized use.

Rental equipment may contain GPS, telematics, or other anti-theft/location technology. Where such technology is used, information may be used for legitimate purposes including theft prevention, equipment recovery, fleet management, maintenance, and enforcement of the rental agreement, subject to applicable privacy law.

Tampering with or disabling a tracking or security device is prohibited.

24. Cancellation and Refunds

Reservations, cancellations, credits, deposits, early returns, and refunds are governed by our Refund & Cancellation Policy and any applicable rental agreement.

25. Availability

Equipment availability shown or discussed before confirmation is not guaranteed.

Equipment can occasionally become unavailable because of breakdown, damage from a previous rental, delayed returns, unsafe conditions, or circumstances beyond our reasonable control.

If we cannot provide reserved equipment, we will make reasonable efforts to offer alternative equipment, reschedule the rental, provide an appropriate credit, or refund amounts paid for equipment or services we cannot provide, as applicable.

26. Website Information

We attempt to keep equipment descriptions, specifications, availability, photographs, and pricing accurate.

However, specifications and photographs may be representative, and actual equipment may differ.

Final pricing and rental details are those confirmed in the reservation or rental agreement.

27. Governing Law

These Terms and rental transactions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer protection or other legislation.

28. Changes to These Terms

We may update these Terms periodically.

The Terms applicable to a rental will generally be those in effect when the reservation or rental agreement is entered into, unless otherwise agreed or required by law.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
